Client

Any professional, individual with legal capacity within the meaning of Articles 1123 et seq. of the French Civil Code, or legal entity visiting the Website covered by these terms and conditions.

All elements making up the information presented on the Website, including text, images, and videos.

Client Information

Hereinafter referred to as “Information,” meaning all personal data that may be held by www.abakus-securite.fr for account administration, client relationship management, analysis, and statistics.

User

Any Internet user who connects to and uses the Website.

Personal Information

“Information which, in any form whatsoever, directly or indirectly enables the identification of the individuals to whom it applies” (Article 4 of French Act No. 78-17 of January 6, 1978).

The terms “personal data,” “data subject,” “processor,” and “sensitive data” have the meanings assigned to them by the General Data Protection Regulation (GDPR No. 2016/679).

The Website is an intellectual work protected under the French Intellectual Property Code and applicable international regulations. The Client may not reuse, transfer, or exploit for its own benefit all or part of the Website’s elements or works.

Use of www.abakus-securite.fr constitutes full acceptance of these terms of use. They may be amended or supplemented at any time, and Users should review them regularly.

The Website is normally available at all times. Abakus Sécurité may interrupt access for technical maintenance and will endeavor to provide advance notice of the relevant dates and times. The Website and this legal notice may be updated or amended at any time. Any amendments apply to Users, who are encouraged to consult this page regularly.

3. Description of services provided

The purpose of www.abakus-securite.fr is to provide information about the company’s activities. Abakus Sécurité endeavors to provide information that is as accurate as possible but cannot be held liable for omissions, inaccuracies, or deficiencies in updates, whether attributable to Abakus Sécurité or to third-party partners providing information.

All information on the Website is provided for general information only, may change, and is not exhaustive. It is subject to any modifications made after publication.

4. Technical limitations

The Website uses JavaScript. It cannot be held liable for damage to equipment arising from use of the Website. Users agree to access the Website using recent, virus-free equipment and an up-to-date modern browser.

The Website is hosted by a service provider located within the European Union in accordance with GDPR No. 2016/679.

The goal is to provide the highest possible availability. The hosting provider operates its service 24 hours a day, every day of the year, but may interrupt service for the shortest possible time for maintenance, infrastructure improvements, failures, or abnormal traffic generated by the Services.

Abakus Sécurité and the hosting provider cannot be held liable for failures of the Internet, telephone lines, computer systems, or telecommunications equipment, including network congestion preventing access to the server.

5. Intellectual property and infringement

Abakus Sécurité owns the intellectual-property rights, or holds valid rights of use, for all elements available on the Website, including text, images, graphics, logos, videos, icons, and sounds.

Any reproduction, representation, modification, publication, or adaptation of all or part of the Website, by any means or process, is prohibited without Abakus Sécurité’s prior written authorization.

Any unauthorized use of the Website or any of its elements may constitute infringement and may be prosecuted under Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitation of liability

Abakus Sécurité acts as the Website publisher and is responsible for the quality and accuracy of the Content it publishes.

Abakus Sécurité cannot be held liable for direct or indirect damage to a User’s equipment when accessing the Website where such damage results from equipment that does not meet the requirements set out in Section 4, or from a bug or incompatibility.

Abakus Sécurité cannot be held liable for indirect losses, such as loss of business or loss of opportunity, resulting from use of the Website.

Interactive areas, including the contact area, may be available to Users. Abakus Sécurité reserves the right to remove, without prior notice, any content that violates French law, particularly data-protection rules. It may also seek to establish the User’s civil or criminal liability, especially in the case of racist, insulting, defamatory, or pornographic messages, regardless of the medium used.

7. Personal-data management

Clients are informed of the rules governing marketing communications, the French legislation on confidence in the digital economy, the French Data Protection Act, and GDPR No. 2016/679.

7.1 Data controller

For Personal Data collected when a User account is created and while Users browse the Website, the data controller is Abakus Sécurité, represented by Eric LIEURE, its legal representative.

As data controller, Abakus Sécurité undertakes to comply with applicable legal requirements. In particular, it determines the purposes of processing, provides prospects and clients with complete information about processing, and maintains an accurate record of processing activities. Whenever Abakus Sécurité processes Personal Data, it takes reasonable steps to ensure that the data is accurate and relevant to the intended purposes.

7.2 Purposes of data processing

Abakus Sécurité may process all or part of the data in order to:

• enable browsing and manage and track services ordered by the User, including connection and usage data, billing, and order history;
• prevent and combat computer fraud, including spam and hacking, using information such as the equipment used, IP address, and hashed password;
• improve Website navigation through connection and usage data;
• conduct optional satisfaction surveys using email addresses;
• conduct communications campaigns by text message or email using telephone numbers and email addresses.

Abakus Sécurité does not sell personal data. Personal data is used only when necessary or for statistical and analytical purposes.

7.3 Rights of access, correction, and objection

Under applicable European data-protection law, Users have the following rights, among others:

• the right of access (GDPR Article 15), correction (Article 16), updating, and completion; and the right to restriction or erasure (Article 17) where data is inaccurate, incomplete, ambiguous, outdated, or unlawfully collected, used, disclosed, or retained;
• the right to withdraw consent at any time (GDPR Article 13(2)(c));
• the right to restriction of processing (Article 18);
• the right to object to processing (Article 21);
• the right to data portability for data provided by Users where processing is automated and based on consent or a contract (Article 20);
• the right to determine how data should be handled after death and to designate the person to whom Abakus Sécurité may or may not disclose that data.

When Abakus Sécurité learns of a User’s death and no instructions have been provided, it undertakes to delete the User’s data unless retention is required as evidence or to comply with a legal obligation.

Users who wish to learn how Abakus Sécurité uses their Personal Data, request a correction, or object to processing may write to:

Users must identify the Personal Data they wish to have corrected, updated, or deleted and provide proof of identity. Deletion requests remain subject to legal document-retention and archiving requirements. Users may also file a complaint with the French data-protection authority, the CNIL, through its online complaint service.

7.4 No unauthorized disclosure of personal data

Abakus Sécurité will not process, host, or transfer collected Information to a country outside the European Union or deemed “inadequate” by the European Commission without first informing the Client. Abakus Sécurité may select its technical and commercial processors provided that they offer sufficient guarantees under the GDPR.

Abakus Sécurité takes appropriate precautions to protect Information and prevent disclosure to unauthorized persons. If an incident affecting the integrity or confidentiality of Client Information comes to its attention, Abakus Sécurité will inform the Client as soon as possible and communicate the corrective measures taken. Abakus Sécurité does not collect “sensitive data.”

Personal Data may be processed by Abakus Sécurité affiliates and processors solely for the purposes described in this policy. Within the scope of their respective duties, the personnel most likely to have access are primarily customer-service staff.

7.5 Types of data collected

Data that may be collected from Website Users and that is necessary for operation of the service may be retained for a maximum period of three years—36 months—after the end of the contractual relationship:

• first and last name;
• mailing address;
• email address;
• telephone number.

8. Incident notification and security

Despite all reasonable efforts, no method of transmission over the Internet and no method of electronic storage is completely secure. Absolute security therefore cannot be guaranteed.

If Abakus Sécurité becomes aware of a security breach, it will notify affected Users so that they can take appropriate action. Incident-notification procedures take national and European legal obligations into account. Abakus Sécurité undertakes to inform Clients fully about account-security matters and provide the information they need to meet their own regulatory reporting obligations.

No User Personal Information is published without the User’s knowledge, exchanged, transferred, assigned, or sold to third parties. Only an acquisition of Abakus Sécurité and its rights could result in transfer of such Information to a prospective buyer, who would then be bound by the same data-retention and amendment obligations.

Security

To protect the security and confidentiality of Personal Data, Abakus Sécurité uses networks protected by standard safeguards such as firewalls, pseudonymization, encryption, and passwords.

When processing Personal Data, Abakus Sécurité takes reasonable steps to protect it against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

9. Hyperlinks, cookies, and web tags

The Website contains hyperlinks to other websites. Abakus Sécurité cannot continuously verify the content of external websites and therefore assumes no responsibility for such content.

9.1 Cookies

A “cookie” is a small information file sent to a User’s browser and stored on the User’s device, such as a computer or smartphone.

Because www.abakus-securite.fr is a static website, it does not itself place first-party cookies and does not perform statistical tracking or record visitor browsing activity.

The Website may nevertheless contain links, icons, or modules that lead to other websites or social networks, including LinkedIn. When a User leaves the Website for a third-party platform, that platform may place its own cookies or trackers on the User’s device.

Abakus Sécurité has no control over trackers placed by third-party services and disclaims responsibility for their management or privacy practices. Users should review the relevant third party’s cookie policy.

Users may configure their browser to accept or refuse cookies. Because browser settings vary, Users should consult their browser’s help menu.

9.2 Web tags

Abakus Sécurité may occasionally use web tags—also known as action tags, one-pixel GIFs, transparent GIFs, or invisible GIFs—and deploy them through a web-analytics provider that may be located in another country and may store related information, including the User’s IP address, there.

These tags may be placed in online advertisements that lead visitors to the Website and on Website pages. The technology may be used to evaluate visitor responses, the effectiveness of activities, and Website use.

The external provider may collect information about visitors to the Website and other websites through these tags, prepare reports on Website activity for Abakus Sécurité, and provide other services related to Website and Internet use.

10. Governing law and jurisdiction

Any dispute relating to use of www.abakus-securite.fr is governed by French law. Except where prohibited by law, exclusive jurisdiction is granted to the competent courts of Paris, France.
